1. Use of the NordInsight Implant Database

NordInsight provides an informational database to assist healthcare professionals in assessing MRI safety conditions for implants. The database is intended to supplement, not replace, independent medical judgment and verification with the original manufacturer of the implant.

By using the database, you acknowledge and agree that:

• NordInsight is not responsible for any clinical decisions made based on the information provided.
• You assume full responsibility for verifying MRI safety conditions before proceeding with any medical procedure.
• The database is not designed to store or process patient-identifiable health information (PHI).
• You must not upload, submit, or input any PHI unless expressly permitted through a Business Associate Agreement (BAA).

2. No Medical Advice

NordInsight is not a medical device and does not provide medical advice, diagnosis, or treatment recommendations. The database aggregates MRI-conditional information published by manufacturers and is intended solely as a reference tool. It does not interpret, modify, or generate individualized safety recommendations.

You acknowledge that:

• NordInsight does not guarantee the accuracy, completeness, or applicability of any information provided.
• You must verify all implant safety conditions directly with the manufacturer before making any clinical decisions.
• NordInsight shall not be liable for any medical decisions, patient injuries, or damages resulting from the use of the database.

3. CPT® Code Report Generator Disclaimer

NordInsight provides a CPT® code written report generator to assist healthcare providers in documenting implant research and MRI safety assessments for insurance reimbursement purposes in the United States.

• The tool follows the latest publicly available CMS and AMA guidelines and is developed in consultation with clinical advisors and key opinion leaders.
• NordInsight does not guarantee payer acceptance, acknowledgment, or reimbursement of claims based on these reports.
• Use of the tool is at the sole discretion of the healthcare provider, who remains responsible for accuracy, completeness, and compliance.

The CPT® code report generator is for informational and documentation support only. It should not be interpreted as billing advice, clinical guidance, or legal recommendation, and may require manual review and supplementation depending on payer-specific requirements.

CPT® is a registered trademark of the American Medical Association (AMA). All CPT® codes used within the NordInsight platform are for reference only. NordInsight shall not be liable for denied claims, reimbursement delays, or financial losses resulting from use of this feature.

4. Disclaimer of Warranties and Limitation of Liability

The database is provided "as is" and "as available" without warranties of any kind. NordInsight makes no representations or warranties regarding the accuracy, reliability, or completeness of the information; the availability, uninterrupted use, or performance of the database; or compliance with specific regulatory requirements in any jurisdiction.

Under no circumstances shall NordInsight, its officers, employees, affiliates, or agents be liable for direct, indirect, incidental, special, punitive, or consequential damages; medical errors, incorrect MRI safety decisions, patient harm, or revenue loss; or data inaccuracies, downtime, or service interruptions.

Limitation of Liability: NordInsight's total liability shall not exceed the total subscription fees paid by the user in the last 12 months.

5. Responsibility of the Healthcare Professional

The healthcare professional is solely responsible for:

• Verifying all information with the original manufacturer before making medical decisions.
• Ensuring compliance with applicable laws, regulations, and professional standards.
• Using the database in accordance with professional judgment and expertise.

By using the database, you represent and warrant that you are a qualified healthcare professional. NordInsight shall not be liable for consequences arising from misuse, reliance, or failure to verify information with manufacturers.

6. Indemnification

You agree to defend, indemnify, and hold harmless NordInsight, its officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, or expenses (including legal fees) arising from your use or misuse of the database, your failure to verify implant safety conditions with the manufacturer, or your violation of these Terms & Conditions or applicable laws. This indemnification obligation survives termination of your use of the database.

7. Changes to the Terms and Conditions

NordInsight reserves the right to modify or update these Terms & Conditions at any time. In case of a material change, NordInsight will provide 30 days' notice before the new terms take effect. By continuing to use the database after updates take effect, you agree to be bound by the revised terms. If you do not agree, you must stop using the database immediately.

8. Acceptable Use Policy

By using NordInsight, you agree to use the platform solely for its intended purpose: supporting MRI safety workflows and documentation through reference to manufacturer-provided implant data.

a. Prohibited Data Use

• Do not upload or store patient-identifiable information (PHI) unless explicitly permitted through a BAA.
• Do not use NordInsight to generate or automate clinical decisions without independent verification.

b. Improper Access or Interference

• Do not breach any applicable law or regulation.
• Do not scrape, mine, crawl, or harvest data manually or through automation without written permission.
• Do not reverse-engineer, decompile, or disassemble the platform.

c. Unlawful or Misleading Use

• Do not create derivative products or services unless authorized.
• Do not present NordInsight outputs (including CPT reports or implant data) as medical advice or regulatory guidance.
• Do not imply that NordInsight makes patient-specific scan decisions.

d. Account Responsibility

• You are responsible for maintaining the confidentiality of your credentials.
• You may not share credentials or use NordInsight for third parties not covered by your license.

9. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of Denmark, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of Denmark. To the extent permitted by applicable law, you waive any claims under the laws of other jurisdictions.
